Color Accuracy: Screen displays vary by device. We cannot guarantee that your monitor shows colors exactly as they appear in person.
Leather Variation: Natural leather contains unique grain patterns, scars, wrinkles, and color variations. These are features, not defects.
Engraving Depth: Laser engraving produces slight variations in depth and darkness depending on the material batch. Your product may differ marginally from mockup images.
Measurements: All dimensions (hat sizes, glass capacities) are approximate. Please refer to our sizing guides before ordering.

Product Availability

All products are subject to availability. We reserve the right to:

Discontinue any product at any time without notice
Limit quantities available for purchase
Refuse or cancel orders for products that become unavailable after order placement

If a product becomes unavailable after you order but before shipment, we will notify you and offer either a full refund or substitute product of equal or greater value at no additional cost.

Pricing Errors

While we make every effort to ensure accurate pricing, errors may occasionally occur. If a product’s correct price is higher than the price displayed, we will:

Contact you before processing the order to confirm your willingness to pay the correct price
Cancel the order and issue a full refund if you do not wish to proceed

We are not bound by pricing errors that are clearly unintentional (e.g., a $500 product listed for $5).

Reservation of Rights

Limit or cancel quantities purchased per person, per household, or per order
Reject, cancel, or modify orders that appear to be placed by resellers or distributors without prior authorization

V. Custom Engraving Policy

User-Provided Content

When you submit text, images, logos, or other content for engraving on our products, you:

Warrant that you own or have valid license to use that content
Warrant that the content does not infringe any third-party intellectual property, privacy, or publicity rights
Warrant that the content complies with all applicable laws (including prohibitions on hate speech, harassment, and illegal activity)
Grant MC Craft LLC a non-exclusive, royalty-free license to reproduce and engrave the content for the sole purpose of fulfilling your order
Indemnify MC Craft LLC against any claims arising from your content

Prohibited Content

We reserve the right to refuse engraving of any content that:

Contains profanity, obscenity, or sexual imagery
Promotes violence, hatred, or discrimination
Infringes trademarks or copyrights (e.g., sports team logos without license)
Contains political campaign material
Depicts illegal activities or drug use

If we reject your content, we will notify you and offer a full refund or alternative design.

Proofing and Approval

For custom engravings, we may provide a digital mockup (proof) for your approval before production. You are responsible for:

Carefully reviewing all text for spelling, grammar, and accuracy
Verifying placement, font, and sizing
Responding to proof requests within 48 hours

If you approve the proof or fail to respond within 48 hours:

Production will proceed based on the proof or your original submission
You accept responsibility for any errors present in the approved proof
Subsequent corrections will be treated as new orders at full price

No Liability for User Errors

MC Craft LLC is not responsible for:

Misspellings, incorrect dates, or wrong names submitted by you
Poor image quality when you provide low-resolution artwork
Misalignment when your instructions are ambiguous or incomplete

VI. Pricing and Payment

Prices

All prices are listed in United States Dollars (USD). We reserve the right to change prices at any time without prior notice. Price changes do not affect orders already placed and confirmed.

Prices exclude:

Sales tax: Applied only for shipping addresses in Hawaii and California
Shipping costs: Calculated at checkout based on destination and shipping method
Customs duties and import taxes: Applicable for international orders, payable by customer

Payment Methods

We accept payments through Stripe, which supports:

Payment Authorization

When you place an order:

Stripe places a temporary authorization hold on your card for the full amount
Your card is charged when your order enters production (typically within 4 hours)
If payment fails, we will notify you and hold your order for 48 hours pending updated payment information

Billing Information

You agree to provide current, complete, and accurate billing information. We reserve the right to:

Cancel any order if billing information cannot be verified
Charge additional fees for address corrections or failed payment attempts
Report fraudulent transactions to law enforcement and credit reporting agencies

Promotional Codes

From time to time, we may offer promotional discount codes. These codes:

Are valid only for specified products or order minimums
Cannot be combined with other offers
Have expiration dates (see code terms)
Have no cash value and are not redeemable for gift cards
May be revoked at any time if obtained through unauthorized channels

VII. Shipping and Delivery

Shipping Policy Overview

MC Craft LLC ships to addresses within the United States (including Alaska, Hawaii, and U.S. territories) and to over 35 international countries. Our detailed Shipping Policy is a separate document that supplements these Terms. In case of conflict, the Shipping Policy governs shipping-specific matters.

Processing Time

Orders are processed within 1-3 business days after payment confirmation, excluding:

Weekends and federal holidays
Times when we are awaiting custom design approval from you
Periods of unusually high volume (e.g., November-December)

Processing includes: quality inspection, engraving (for custom items), packaging, and handoff to carrier.

Delivery Estimates

Delivery timeframes provided at checkout are estimates only, not guarantees. Actual delivery depends on carrier performance, customs clearance (international), weather, and other factors beyond our control.

Estimated transit times after processing:

USA (contiguous): 3-7 business days
Alaska/Hawaii: 5-10 business days
Canada: 5-10 business days
United Kingdom: 7-12 business days
Australia/New Zealand: 8-14 business days
Europe: 7-14 business days
Other international: 10-20 business days

Risk of Loss

Title and risk of loss pass to you upon delivery of products to the carrier. We are not responsible for:

Lost, stolen, or delayed packages after carrier pickup
Damage caused by carrier mishandling (file claim with carrier directly)
Incorrect addresses provided by you

Shipping insurance is included on all orders over $50. For orders under $50, insurance is optional at checkout.

Customs and Import Duties

For international orders:

You are the importer of record and responsible for compliance with your country’s import laws
Customs duties, VAT, and handling fees are your responsibility
We are not responsible for packages delayed or seized by customs
We cannot declare lower values or mark items as “gifts” to avoid duties (this is illegal)

If you refuse to pay customs duties and the package is returned to us, we will refund the product cost minus original and return shipping fees.

VIII. Returns and Refunds

Return authorization required before shipping
Personalized items have limited return eligibility
Restocking fees apply in certain situations

Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to:

Access and use the Site for personal, non-commercial purposes
View and print product pages for personal reference

This license does not include:

Any commercial use of the Site or its contents
Copying, reproducing, distributing, or creating derivative works from our content

Copyright Infringement Claims (DMCA)

Natural Product Variations

Leather is a natural material. Each hide has unique characteristics including scars, grain patterns, and color variations. These are not defects but features that make your product unique. We do not warrant that your leather product will match the exact appearance of any sample or image.

Glass engraving depth may vary slightly based on the specific glass batch. All engravings are permanent and dishwasher-safe, but no warranty covers breakage from mishandling.

XV. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MC CRAFT LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR:

INDIRECT DAMAGES: Any indirect, incidental, special, consequential, or punitive damages
LOST PROFITS: Loss of profits, revenue, data, or business opportunities
REPUTATIONAL HARM: Damage to reputation or goodwill

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF OUR PRODUCTS SHALL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE SPECIFIC PRODUCT GIVING RISE TO THE CLAIM.

This limitation applies regardless of the legal theory (contract, tort, negligence, strict liability, or otherwise) and whether or not we were advised of the possibility of such damages.

EXCEPTIONS: Some jurisdictions do not allow limitations on liability for death, personal injury, or fraud. In those jurisdictions, our liability is limited to the maximum extent permitted.

Force Majeure

We are not liable for any delay or failure to perform resulting from causes outside our reasonable control, including but not limited to:

War, terrorism, riots, civil unrest
Pandemics, epidemics, quarantines
Labor strikes or shortages
Carrier delays or infrastructure failures
Government actions or regulations
Power outages or internet service disruptions

If a force majeure event occurs, our obligations are suspended for the duration of the event. We will make reasonable efforts to resume performance as soon as practicable.

XVI. Indemnification

You agree to indemnify, defend, and hold harmless MC Craft LLC and our officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from or related to:

Your violation of these Terms
Your use of the Site or products
Your submission of content (including engraving designs) that infringes any third-party rights
Your violation of any applicable law or regulation
Your negligent or wrongful conduct

We reserve the right to assume exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate with us in asserting available defenses.

XVII. Governing Law and Dispute Resolution

Governing Law

These Terms and any dispute arising from them shall be governed by and construed in accordance with the laws of the State of Hawaii, United States of America, without regard to its conflict of law principles.

Dispute Resolution Process

Step 1 – Informal Resolution: Before filing any legal action, you agree to contact us at minhchichu655@gmail.com to attempt to resolve the dispute informally. We will make good faith efforts to resolve the matter within 30 days.

Step 2 – Binding Arbitration: If informal resolution fails, any dispute, claim, or controversy arising out of these Terms or your use of our products shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.

Arbitration shall take place in Honolulu, Hawaii
The arbitrator’s decision shall be final and binding
Judgment on the award may be entered in any court having jurisdiction

Exceptions: Either party may bring a claim in small claims court (if within jurisdiction) or seek injunctive relief in a court of competent jurisdiction to protect intellectual property rights.

Arbitration Costs

For claims under $10,000, you may choose whether the arbitration proceeds on the basis of documents submitted, by telephone, or by in-person hearing. MC Craft LLC will pay all arbitration fees for claims under $10,000 unless the arbitrator finds your claim frivolous.

XVIII. Class Action Waiver

YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS, WHETHER IN ARBITRATION OR COURT, WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT AS A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.

You waive the right to participate as a class representative or class member in any class action lawsuit. The arbitrator may not consolidate more than one person’s claims or preside over any representative or class proceeding.

If this class action waiver is deemed unenforceable, then the entire arbitration agreement (Section XVII) shall be null and void, and disputes shall be resolved in the state or federal courts of Honolulu, Hawaii.

XIX. Severability

If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

XX. Entire Agreement

These Terms, together with our Privacy Policy, Shipping Policy, Refund and Return Policy, and any other legal notices published on the Site, constitute the entire agreement between you and MC Craft LLC regarding your use of the Site and purchase of products.

Any prior agreements, understandings, or representations, whether written or oral, are superseded by these Terms.

XXI. Force Majeure

As stated in Section XV, we are not liable for delays or failures caused by events beyond our reasonable control. This includes but is not limited to acts of God, war, terrorism, pandemic, labor disputes, carrier interruptions, and government actions.

During a force majeure event:

Processing and shipping timeframes are suspended
We will notify affected customers as soon as practicable
You may cancel your order for a full refund if the event prevents fulfillment within 60 days
